KASHMIR: INDIAN JUDICIARY WILL NOT PUNISH THE MURDEROUS INDIAN ARMY

The year 2000 is always remembered for its ever fading incidence that took place especially the month of March. In this month after 22 years, an American President’s visit to India explicitly announced the changes in the political and geographical alliances in the sub-continent regions that had taken place ever since the Cold War. Clinton visit was celebrated with all pride and pomp by India, terming it as a defeat of Pakistan’s diplomatic relationship. Without any shame India announced it as a great victory in achieving the friendly relationship of the super power from its competitor in this sub-continent region. The same was even announced by the ruling class. There was boundless happiness to the corporate media and its joy had no limits. During this event, one evening on March 20th at Kashmir 17 armed men in the wearing Indian Army fatigues entered the village of Chattisinghpura of Anantnag District. It ordered the members of Sikh community to assemble at the entrance of village Gurudwara. All men and children assembled at the entrance of village Gurudwara. On the spur of the moment a gun fire was conducted on the unarmed civilians. 34 people were killed in this dreadful massacre. After this brutal massacre furiously the ruling political class and media complained it as Pakistan’s conspiracy to attack India. Aftermath the massacre there was a wide spread propaganda stating Pakistan was envoys because of Clinton’s trip to India entered into such cowardice attack. Immediately, the Government of India vowed that it would retaliate. On March 25, 2000 Indian army entered village at Pathribal at Anantnag District and it surrounded a small hut.  Indian Army with all pride announced that members of the terrorist troop were attacked by the Indian army and during that attack five people were killed. America condemned this Chattisinghpura massacre said this attack was done by some unidentified group. Later in 2004, Bill Clinton in his autobiography “My Life” has mentioned as “unidentified”group. In the same year, Clinton’s close associate Strobe Talbott in his book wrote Clinton did not believe that Pakistan had its hand in this Chattisinghpura massacre. Immediately, aftermath the Pathribal encounter people from that village entered into protest. The local population informed that the people who was attacked during the encounter were innocent civilians who belong to the same village they are not terrorist. Further, from March 21st to 24th March Indian army approximately took 17 members and those members were missing. Subsequent to this incident there was wide spread protest rising in Kashmir. Because of the rising protest by people of Kashmir, when the protest reached its heights Kashmir Chief Minister Farooq Abdullah ordered for a probe. The corpus of the persons who were killed and the DNA samples of close relatives of the missing persons were collected and were sent for Forensic investigation to Kolkata and Hyderabad. After investigation and inquiry it was found that persons who were killed in the encounter on April 2002 and persons who were missing are not “foreign militants”, they are innocent civilians belonging to the same village. Subsequently, on January 2003 CBI was appointed to investigate this fake encounter. Meanwhile, America refused to recognize and declare that Pakistan terrorists and ISI intelligence agency had its involvement in the Chattisinghpura Sikh Massacre. During these circumstances there was an unexpected turning point. Government of India announces two terrorists belonging to Lashkar-e-Taiba who were involved in attack were arrested by the Indian Army in the August 2000. Mohamed Suhail Malik, who was one of the terrorist arrested, gave an interview to New York Times in the month of December the very same year.
In the history of India a great wonder took place when an arrested Pakistani terrorist giving an interview to an American newspaper. During his interview he gave a confession that he belonged to Sialkot region and Lashkar organization has trained him for terrorist activity he along with his companion has intruded and has committed the Chattissinghpura Sikh Massacre. This story did not conclude here. A last turning point took place after 10 years. The Delhi High Court which was hearing the Chattissinghpura Sikh Massacre on 10th August, 2011 acquitted the two militants, Mohamed Suhail Malik and Wasim Ahmed the co-accused who was arrested along with him stating that, they did not had any relation with the Massacre. Meanwhile, CBI which concluded its enquiry on Pathribal Fake Encounter gave a report stating that persons who were killed are innocent civilians and that was a fake encounter. Brigadier Ajay Saxena, Major Bijendra Pratap Singh, Major Saurabh Sharma, Major Amit Saxena and Subedar Idris Khan according to CBI these were the persons responsible to said fake encounter. Outcome of this truth made several human rights activist and some democratic organizations to get agitated. Before the Division Bench of the Supreme Court, the CBI placed its observation on the investigation and argued furnishing all the evidence. The outcome of its report was what has happened at Pathribal village was a cold-blooded murder. On June 2012, the Army which has foreseen the outcome of the proceeding requested a court-martial proceeding before the Supreme Court. On 23rd December 2013, the military tribunal disposed of the case stating the evidence recorded could not establish a prima-facie case against any of the accused persons. One of the victim Abdul Rasheed Khan (Shakoor Ahmad Khan) whose father Juma Khan was killed in fake encounter says “The very day when the Supreme Court denied the argument of CBI and transferred the case to Military Tribunal, we lost our confidence.  But still we appeared with the thought because of non-appearance of witnesses the case should not get disposed off. We were well aware of the outcome of this decision.”Any individual who rationally analyse the incident of the Indian Army can come to a conclusion that it is a cold-blooded murder. Any one can realize the injustice and the brutal act of the Army. This kind of brutality against the innocent civilians of Kashmir time now and then has led to frustration and turning them towards terrorism. This is because of the Government of India’s atrocities in comparison with Pakistan’s instigation.
Kashmiri people realized that Indian army is a murderous army and Indian justice system is nothing but a system of INJUSTICE. Support the RIGHT TO SELF-DETERMINATION of Kashmiris including the right to secession.
